Law professor calls for Kavanaugh investigation

A St. Thomas law professor is one of three former Yale classmates and previous supporters of Brett Kavanaugh who are calling for investigation into allegations of sexual misconduct against the Supreme Court nominee.

The Washington Post reported that Mark Osler, professor and distinguished chair in law, joined with Kent Sinclair and Douglas Rutzen in support of an investigation into at least two claims of sexual misconduct from the 1980s. Osler, Sinclair and Rutzen graduated with Kavanaugh in 1990.

In a phone interview with MPR, Osler said a federal investigation is the best way to get information from as many people involved in the accusations as possible.

“In the absence of an investigation where you don’t have that kind of objective corroboration, what it does is puts way too much pressure on the demeanor of the witnesses,” Osler told MPR. “Because we’re not hearing other things, we’re not having many other facts to set up against what we’re hearing; we look at them, and we watch how they react, and that’s often not fair.”

Osler was one of 23 signatories on an Aug. 27 letter to the Senate Judiciary Committee, expressing bipartisan support for Kavanaugh.

Kavanaugh has denied all allegations. The Senate Judiciary Committee will hold a hearing Thursday, Sept. 27 to hear from both Kavanaugh and one of the accusers.
